Introduction

These Website Standard Terms and Conditions written on this webpage shall manage your use of our website, BOOSTEXE accessible at https://www.boostexe.com, as well as any services offered under the BX Services brand (1-to-1 PC optimization sessions). By using this Website or purchasing any service, you agree to accept all terms and conditions written here. You must not use this Website or our services if you disagree with any of these Terms.

Minors or people below 18 years old are not allowed to use this Website or purchase services, unless parental or legal guardian consent has been provided.

Description of Services

CALABRESE COMPUTING offers software products available for download through this Website, as well as remote PC consulting and optimization services under BX Services, including but not limited to:

• CPU undervolt and overclock (CPU Tune)
• GPU undervolt, overclock and fan curve (GPU Tune)
• Troubleshooting and optimization recovery (PC Recovery)
• Combined CPU + GPU packages (Full Tune)
• Stability verification and performance analysis (Performance Audit)
• Network optimization for gaming (Network Overhaul)
• Complete multi-session package (Total System Package)

All 1-to-1 services are delivered exclusively remotely via remote desktop software (AnyDesk, Parsec or equivalent). No service is provided on-site or with physical access to the Client's hardware.

Intellectual Property Rights

Other than the content you own, under these Terms, CALABRESE COMPUTING and/or its licensors own all the intellectual property rights and materials contained in this Website. You are granted a limited license only for purposes of viewing the material contained on this Website.

All optimization methods, procedures, presets, configurations and know-how used by BX Services are intellectual property of BoostExe. You may not:

• Reproduce, distribute or resell optimization procedures learned during a session for commercial purposes;
• Record any session (video/audio) without prior written consent from BX Services;
• Use knowledge acquired during sessions to offer competing services.

Restrictions

You are specifically restricted from all of the following:

• publishing any Website material in any other media;
• selling, sublicensing and/or otherwise commercializing any Website material;
• publicly performing and/or showing any Website material;
• using this Website in any way that is or may be damaging to this Website;
• using this Website in any way that impacts user access to this Website;
• using this Website contrary to applicable laws and regulations, or in any way may cause harm to the Website, or to any person or business entity;
• engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website;
• using this Website to engage in any advertising or marketing.

Certain areas of this Website are restricted from being accessed by you and CALABRESE COMPUTING may further restrict access by you to any areas of this Website, at any time, in absolute discretion. Any user ID and password you may have for this Website are confidential and you must maintain confidentiality as well.

Software Usage Restrictions

Any software made available for download through this Website is licensed, not sold, to you by CALABRESE COMPUTING. Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable license to install and use one (1) copy of the software on a single computer or device owned or controlled by you.

You are expressly prohibited from:

• Installing or using the software on more than one device at a time;
• Sharing, distributing, or making the software available over a network, cloud service, or any system allowing multiple users;
• Reverse engineering, decompiling, or disassembling the software;
• Selling, renting, leasing, or sublicensing the software;
• Modifying or creating derivative works based on the software;
• Removing or altering any proprietary notices or labels contained in the software.

Client Requirements for 1-to-1 Sessions

To use BX Services remote optimization sessions, you agree to:

• Provide accurate and complete information about your system's hardware specifications before the session;
• Ensure a stable internet connection throughout the entire session;
• Be present at the PC for the entire duration of the session;
• Perform a complete backup of all important data before the session — BX Services is not responsible for data loss;
• Install the required remote desktop software before the scheduled time;
• Close all non-essential programs before the session begins.

Remote Access and Security

By booking a session, you expressly authorize the BX Services technician to access your computer via remote desktop software for the duration of the session. You may:

• Observe in real time all operations performed by the technician;
• Interrupt the session and revoke remote access at any time;
• Request explanations for any action performed by the technician.

BX Services commits to not accessing, copying, modifying or deleting personal files that are not strictly necessary for service delivery. Remote access is used exclusively for the agreed optimization operations.

Overclocking and Undervolting Risks

BY PURCHASING AN OPTIMIZATION SERVICE, YOU ACKNOWLEDGE AND ACCEPT THAT:

• Overclocking and undervolting involve modifying hardware operating parameters outside of the manufacturer's factory specifications;
• Such modifications may, in extreme cases, reduce the lifespan of hardware components, even when applied correctly;
• Overclocking and/or undervolting may void the manufacturer's warranty on the affected components (CPU, GPU, RAM, motherboard), as confirmed by official Intel, AMD and NVIDIA policies;
• During the optimization process, the system may experience sudden restarts, crashes or blue screens (BSOD) as a normal part of the procedure for finding stable limits;
• Results vary based on individual chip quality ("silicon lottery"), cooling system, power supply and overall system configuration;
• BX Services cannot guarantee specific results in terms of FPS, temperatures or benchmark scores. Indicative estimates are provided as ranges (e.g. "5-15% improvement").

By proceeding with the purchase of a service, you declare that you have fully understood and accepted the risks described above and release BX Services from any liability arising from such risks.

Your Content

In these Website Standard Terms and Conditions, "Your Content" shall mean any audio, video text, images or other material you choose to display on this Website. By displaying Your Content, you grant CALABRESE COMPUTING a non-exclusive, worldwide irrevocable, sub licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

Your Content must be your own and must not be invading any third-party's rights. CALABRESE COMPUTING reserves the right to remove any of Your Content from this Website at any time without notice.

No Warranties

This Website is provided "as is," with all faults, and CALABRESE COMPUTING expresses no representations or warranties, of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.

Payments and Billing

Software subscriptions: By purchasing a subscription on boostexe.com, you authorize us to automatically charge your selected payment method on a recurring basis (e.g., monthly or annually) until you cancel. You can cancel your subscription at any time through your account dashboard or by contacting our support team at [email protected]. Charges will occur at the beginning of each billing cycle.

1-to-1 optimization sessions: 100% upfront payment is required at the time of booking to confirm the session. Accepted payment methods are PayPal and bank transfer. Free cancellation is available up to 24 hours before the scheduled session time. Cancellations made with less than 24 hours' notice are not eligible for a refund. In the event of a no-show, no refund is provided; however, the Client may reschedule once.

Refund Policy

Software subscriptions: We offer refunds only under the following condition: you may request a refund within fourteen (14) days of your first purchase if your PC's performance did not increase by at least 5% after the optimization. One of our team members will personally verify the result through official benchmarking tests. After this 14-day period, you will no longer be eligible for a refund. To request a refund, you must contact our support team within the 14-day window using the same email address used for the purchase. We reserve the right to refuse refund requests that do not comply with these conditions.

1-to-1 optimization sessions: No refunds are provided for regularly completed sessions. If no measurable and documentable improvement is achieved, BX Services will offer a free follow-up session as a remedy. This does not imply any right to a monetary refund.

Post-Session Warranty

BX Services offers a limited post-session warranty under the following conditions:

• Duration: 7 days from the session completion date for Tier 1 and Tier 2 services; 30 days for the Total System Package.
• Coverage: The warranty exclusively covers instability or issues directly caused by modifications applied during the session.
• Exclusions: The warranty does not cover issues arising from Windows, driver or BIOS updates performed by the Client after the session; modifications to overclock/undervolt values made by the Client; installation of new software or hardware; or pre-existing issues unrelated to the service.
• Intervention: In case of issues covered by the warranty, BX Services will provide free remote assistance (maximum 30 minutes) to restore system stability.

Discounts and Promotions

BX Services may offer discount codes for BXTool software as part of service packages. Discount codes:

• Have a limited time validity as specified at the time of issuance;
• Cannot be combined with other offers unless otherwise stated;
• Are non-transferable to third parties;
• May be revoked or modified without notice.

User Responsibility

The user understands and accepts that every action or modification performed within the programs and services provided by CALABRESE COMPUTING is their responsibility. CALABRESE COMPUTING is not responsible for the actions of the user or for any modifications made by the user to our services. This includes, but is not limited to, any customization, configuration, or "tweak" made by the user, as well as any modifications to overclock or undervolt values made after the completion of a BX Services session.

Limitation of Liability

To the maximum extent permitted by applicable law, CALABRESE COMPUTING and BX Services shall not be liable for:

• Any indirect, consequential or special liability arising out of or in any way related to your use of this Website or our services;
• Direct or indirect damage to hardware resulting from overclocking, undervolting or any other modification performed during or as a consequence of a session;
• Loss of data, files, programs or settings during or after a session;
• Incompatibility with future software or driver updates;
• Issues caused by modifications made by the Client after the session;
• Hardware failures unrelated to the service provided;
• Loss of profit, revenue or business opportunities;
• Voiding of the manufacturer's warranty on components.

In any case, the maximum aggregate liability of CALABRESE COMPUTING or BX Services to the Client shall not exceed the amount actually paid by the Client for the specific product or service that gave rise to the dispute.

Force Majeure

CALABRESE COMPUTING and BX Services shall not be liable for delays or inability to deliver services caused by events beyond their reasonable control, including but not limited to: network outages, server failures, natural disasters, pandemics, government actions or any other force majeure event. In such cases, any affected session will be rescheduled at no additional cost.

Indemnification

You hereby indemnify to the fullest extent CALABRESE COMPUTING from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provision shall be deleted without affecting the remaining provisions herein.

Variation of Terms

CALABRESE COMPUTING is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis. Changes will be published on the official website and/or communicated through official channels. Continued use of the Website or services after publication of changes constitutes acceptance of the new Terms. Changes do not apply retroactively to services already purchased and not yet delivered.

Assignment

CALABRESE COMPUTING is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Entire Agreement

These Terms constitute the entire agreement between CALABRESE COMPUTING and you in relation to your use of this Website and our services, and supersede all prior agreements and understandings.

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the Swiss Confederation, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Switzerland for the resolution of any disputes related to the Website and software products.

For disputes arising specifically from BX Services 1-to-1 optimization sessions, the parties commit to first attempting an amicable resolution. In the event of failure, the competent court shall be determined in accordance with applicable EU consumer protection regulations and the law of the Client's country of residence.
